Gimme the Gig II Contest Official Rules
THIS CONTEST IS INTENDED FOR PLAY IN THE UNITED STATES ONLY AND WILL BE GOVERNED BY U.S. LAW. DO NOT PARTICIPATE IN THE CONTEST IF YOU ARE NOT LOCATED IN THE UNITED STATES AT THE TIME OF ENTRY.
NO PURCHASE NECESSARY TO ENTER OR WIN.
1. SPONSOR: The Gimme the Gig II Contest (the "Contest”) is sponsored by Ford Motor Company (the "Sponsor”).
2. ELIGIBILITY: The Contest is open to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older at the time of entry who are not currently under a recording contract with a music recording company. Bands may include up to seven members and each band member must meet the eligibility criteria. Employees of Sponsor, its parent, subsidiary and affiliated companies, and the advertising and promotion agencies involved with this Contest (and the immediate family members of such employees and individuals residing in the same household as such employees) are not eligible to enter or win. Sponsor reserves the right, at any time, to verify eligibility requirements, in any manner it deems appropriate. If it is determined any member of a band is ineligible, the entire band will be disqualified. Void where prohibited.
3. CONTEST PERIOD: The Contest begins on June 15, 2011 at 12:00:01 a.m. PT and ends on November 30, 2011 at 11:59:59 p.m. PT (the “Contest Period”).
4. TO ENTER: Create an original video of you or your band performing one (1) original song (“Video”). Videos must comply with all YouTube format and size requirements (http://www.google.com/support/youtube/bin/answer.py?hl=en&answer=57924) and the technical, creative, and legal requirements set forth in these Official Rules. Please note: You must be a registered user of the YouTube site to enter. To become a registered user of the YouTube site, you must register for an account and agree to the YouTube site’s “Terms of Use” set forth at www.youtube.com/t/terms (“Terms of Use”) and the YouTube Privacy Policy, located at www.youtube.com/t/privacy. Registration on YouTube must be completed before a Video can be submitted. Creating a YouTube account is free. The Sponsor and Promotion Parties are not affiliated with www.youtube.com or the YouTube Site. YouTube is not a sponsor of this Contest. To enter, follow the instructions to upload your Video to YouTube at www.youtube.com. Then visit www.gimmethegig.com (the “Website”), during the Contest Period, and click on the “Bands Enter Here” button to access the Contest registration page. Follow the online instructions to register by providing the requested information for each member of your band, and a link of your Video from YouTube. Your Video must not be longer than 5 minutes in length. Entries must be in English, Chinese, Korean, or Spanish. By submitting a Video, you warrant and represent that your Video complies with the Video Requirements set forth below and the You Tube Terms of Use. Limit: one (1) entry per person/band. Submissions must be received no later than November 30, 2011 at 11:59:59 pm PT.
Videos will be posted to the Website and consumers will be able to vote on which Videos they “like.” Limit one (1) vote per person per 24-hour period. If more than one (1) vote is received from the same person during any given 24-hour period, all votes from said person will be disregarded. Sponsor reserves the right to void all votes made through any script, macro, robotic, automatic, mechanical, programmed or similar duplication method. Any attempt by the entrant and/or his/her respective family/friends to vote more than the number of times authorized herein, and/or any other fraudulent mechanism, as determined by the Sponsor in its sole discretion, shall give the Sponsor the right to disqualify the entrant in Sponsor’s reasonable discretion. Any attempt by any person to fraudulently circumvent the voting restrictions in order to cast multiple votes will result in disqualification of all such votes received and may result in disqualification of the entrants for whom the improper votes were received if the Sponsor determines that that entrant was involved in any way in the perpetration of such fraud. Consumers will also be able to answer a trivia question and share their vote on Facebook via the “Share” functionality. Upon completion of the trivia question and sharing your vote, the Video that you voted for will receive ten (10) additional votes. Sponsor reserves the right to, and may or may not, monitor/screen entries prior to posting them to the Website. By entering, you acknowledge that Sponsor has no obligation to use or post any Video you submit. Submission of an Video grants Sponsor and its agents an unlimited, worldwide, perpetual, license and right to publish, use, publicly perform, edit, alter and duplicate your Video (including the performance, sound recording and musical composition contained therein) in any way, in any and all media, without limitation, and without consideration to you. However, the Sponsor shall have no obligation to use your Video.
By submitting a Video you also represent that neither you nor any member of your band are presently signed to any label or publisher under any exclusive agreements and/or other contractual arrangements, and neither you nor any member of your band are members of any other band that is presently signed to any label or publisher under any exclusive agreements and/or other contractual arrangement. You agree to indemnify and hold Sponsor harmless from any and all claims, demands, causes of action and judgments (including attorney’s fees, court costs and expert’s fees) arising out of relating to any breach by you of the terms and conditions of these rules, including the representations and warranties made herein.
5. VIDEO REQUIREMENTS. Video may not be sexually explicit, violent or contain excessive profanity, or be derogatory of any individual or group. Video also may not promote excessive alcohol use or use of illegal drugs. Videos containing inappropriate content, as determined by the Sponsor, in its sole discretion, will be disqualified. Sponsor’s determinations are final.
By entering this contest, you and the other members of your band, if any (collectively, herein referred to as “you” and/or “your”) warrant and represent that (i) your Video contains only original material, (ii) you own 100% of all rights to your Video (including all copyrights in the sound recording and musical composition contained therein), (iii) your Video does not contain any third party materials owned by third parties, including but not limited to any samples of any materials created by a third party, and (iv) your Video does not otherwise violate or infringe the rights, including, without limitation, copyrights, trademark rights or rights of publicity/privacy, of any third pa rty, and (v) your Video requires no additional permissions relating to the copyright of your Video and/or music submitted in this Contest. By submitting the Video, you agree to indemnify and hold Sponsor harmless from any claims by any third party (including other members of your band) to the contrary.
6 . JUDGING/FINALIST SELECTION: A qualified panel of judges will judge each Video submitted based on the following equally weighted criteria: Performance, Musical Ability, Originality and Overall Appeal (which will be determined in part by the number of “likes” and views for the Video). The fifty (50) highest scoring entrants will be deemed “Regional Qualifiers” and may be invited to perform at a regional event (set forth below) in front of a live audience. In the event of a tie, tie breaker will be based upon the highest score in the first judging criteria, continuing thereafter to each judging criteria in order, as needed, to break the tie. A new panel of judges will judge each for the fifty (50) performances at the regional events, based on the same equally weighted criteria set for the above. Based on the performance at the regional events, the Judges will select twelve (12) Finalists (two (2) from each region and 2 wild card selections) to perform at one of three (3) finalist events in the Western Region in front of Don Was. In the event of a tie, tie breaker will be based upon the highest score in the first judging criteria, continuing thereafter to each judging criteria in order, as needed, to break the tie. Don Was will select three (3) winners (one from each finalist event) based on the same equally weighted criteria set forth above. In the event of a tie, tie breaker will be based upon the highest score in the first judging criteria, continuing thereafter to each judging criteria in order, as needed, to break the tie.
There are five regions: Northwest, Southwest/Phoenix, Mountain States/Denver, Northern California, and Southern California. If regional qualifiers reside outside of the five defined regions, the sweepstakes administers will select which region the qualifier will perform. The venues and dates for the regional events will be selected by the Sponsor and announced on the Website. There may be more than one regional event in each region. Regional Qualifiers and Finalists are solely responsible for all costs associated with travel to/from the venue(s) at which they are invited to perform.
As of 1/6/2012 the rules have been modified to group Northern California and Southern California into one region, for a total of four (4) regions. Four (4) bands will be selected from the California region.
7. PRIZES (3): Each winning band will receive a recording session with Don Was to record one (1) track inside the 2012 Ford Focus (physical location to be determined by the Sponsor). The recording session includes production, remixing, studio time and engineering. Mr. Was will also produce a video of the recording session for the winning bands. Recording and production details will be at the discretion of the Sponsor and Mr. Was. In the event that recording session cannot be accommodated inside Ford Focus, each winning band will receive a recording session with Don Was to record one (1) track in a recording studio to be designated by Sponsor, in its sole discretion.
8. CONDITIONS OF PARTICIPATION: Entrants agree to these Official Rules and the decisions of Sponsor which are final and binding. Entrants further agree that Sponsor, its subsidiary and affiliated companies, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents will have no liability whatsoever for, are released and shall be held harmless from any liability for any injuries, losses or damages of any kind to persons, including death, or property resulting in whole or in part, directly or indirectly, from participation in this Contest or Contest-related. Except where legally prohibited, winners grant permission to Sponsor and those acting under Sponsor’s authority the right to use their name, photograph, likeness, voice, image and biographical information and statements for advertising, trade, publicity and promotional purposes without additional compensation, in all media now known or hereafter discovered, worldwide and on the Internet and World Wide Web, without notice, review or approval.
9. REQUIRED DOCUMENTATION: Regional Qualifiers may be required to complete, sign, and return an Affidavit of Eligibility, a Liability Release and, where lawful, a Publicity Release within seven (7) days of notification. If documents are not returned on a timely basis, or if notification is returned as non-deliverable, or if winner is found to be ineligible or not in compliance with these Official Rules, the opportunity to be a Regional Qualifier will be forfeited.
10. GENERAL PROVISIONS: Neither Sponsor nor its agencies are responsible for not receiving entries, no matter what the reason even if known in advance, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of entry or the failure to capture any such information. Persons who tamper with any aspect of the Contest, as solely determined by the Sponsor, will be disqualified. Any use of robotic, automatic, macro, programmed or like entry methods will void all such entries and disqualify any entrant using such methods. Should any portion of the Contest be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention, technical failures or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Contest.
11. GOVERNING LAW: By entering, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these official rules, participant’s rights and obligations, or the rights and obligations of the sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the state of Michigan, without giving effect to any choice of law or conflict of law rules. By entering, entrants consent to the exclusive jurisdiction and venue of the federal, state and local courts located in Oakland County, Michigan for the resolution of any and all claims or disputes regarding this Contest.
